1. Acceptance of Terms

By accessing or using RealSportsPhotos ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

RealSportsPhotos provides a platform for photographers to certify their sports photography with C2PA content credentials and for users to verify photo authenticity. The Platform includes photo upload, certification, verification, and related services.

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use the Platform. By registering, you represent that you meet this requirement.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.

3.3 Identity Verification

Paid accounts require identity verification. You agree to provide accurate identification documents. False information may result in account termination.

4. Photo Rights and Licensing

4.1 Ownership

You retain all ownership rights to photos you upload. By uploading photos, you represent that you have the legal right to do so and that the photos do not infringe on any third-party rights.

4.2 License to RealSportsPhotos

You grant RealSportsPhotos a worldwide, non-exclusive license to host, store, process, and display your photos for the purpose of providing certification services and operating the Platform.

4.3 Public Display

Certified photos and photographer profiles are publicly viewable by default. You may adjust privacy settings in your dashboard.

5. Prohibited Conduct

You agree not to:

• Upload photos you do not have rights to
• Certify AI-generated or manipulated images as authentic
• Use the Platform for illegal purposes
• Attempt to circumvent security measures
• Harass or impersonate other users
• Upload content containing violence, hate speech, or adult content
• Scrape or data mine the Platform
• Reverse engineer the certification technology

6. Payment and Subscriptions

6.1 Subscription Plans

RealSportsPhotos offers free and paid subscription tiers. Pricing is available at realsportsphotos.com/pricing and may change with notice.

6.2 Billing

Paid subscriptions are billed annually in advance. Payments are processed by Stripe. By subscribing, you authorize recurring charges until you cancel.

6.3 Refunds

We offer a 30-day money-back guarantee for new subscribers. Refund requests must be submitted to support@realsportsphotos.com.

6.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds for partial periods.

7. C2PA Credentials

We use C2PA (Coalition for Content Provenance and Authenticity) standards to generate content credentials. While we strive for accuracy, we do not guarantee that C2PA credentials are tamper-proof or provide absolute verification. Users should understand the limitations of cryptographic verification technology.

8. Intellectual Property

The Platform, including its design, code, and branding, is owned by RealSportsPhotos and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

9. Termination

We may suspend or terminate your account for violations of these Terms, illegal activity, or at our discretion. Upon termination, your right to use the Platform ceases immediately.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

• The Platform will be uninterrupted or error-free
• Defects will be corrected
• The Platform is free of viruses or harmful components
• C2PA credentials provide absolute proof of authenticity
• Certified photos will never be disputed or challenged

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSPORTSPHOTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify and hold RealSportsPhotos harmless from claims, damages, and expenses arising from your use of the Platform, your photos, or your violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive the right to participate in class actions.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
